***I’m going to call my lawyer Monday this is more for peace of mind***
Married Sahm, no income except my husband’s. Filed chapter 7 in Texas July 2025 (just individual not joint) kept car and signed agreement with bank to pay it off (paid off before end of 2025).
I could have sworn I had to claim bankruptcy as taxable income but google (quoting turbo tax) says no but trustee can take part of 2025 return prior to when bankruptcy was filed for time I worked.
But I legit don’t work outside the home or have income of my own. (I’m not being financially abused my husband freely lets me spend I just mean I don’t get a paycheck)
Can they take it if I file married filing separately? Is that playing with fire?
For more info we’re pretty low income (debt came from credit cards I had obtained years and years ago when I did work and had a great career and income and cards were always kept paid off and then stupidly ran them up years after I quit working and I just got behind eventually) like under $50k made for the year and we have 4 kids. I need a root canal and crown on a front tooth (if it wasn’t a top front tooth I’d just yank it and have a gap and call it good but it’s literally an incisor) and we desperately need a second car (ours is 11 years old and getting in worse shape plus sharing is really hard for our circumstances and I need a car to get a job when all my kids are in school full time for the 2026/27 school year.) Nothing super nice just like a used mom van with a good engine.
Any help is appreciated even if it’s bad news I just have bad anxiety and need to know ahead of time what will happen so I can manage it since I don’t take medication for it.
