Firstly I am writing this on behalf of my Mom. I’m helping because this is all very overwhelming.
68k in debt. Originally when consulting back in May 2025 She was told she would qualify for chapter 7 and should she sign they will begin right away… I paid for her around 2500$ (keep in mind I’m not rich and this was a sizable payment for me to make). They said for her to immediately stop paying all debts.
Fast forward about 2 months and after a few emails toward them they finally got back and said that chapter 7 is off the table and that it will now have to be chapter 13 with a 400$ a month payment a month over 3 years. Ok that sucks but doable, she gave the go ahead. Then there was a hickup where she owned part of a trust where she would get 9000$ in like 5 years and that took a while for them to contact the guarantor of the trust or whatever, but my mom was willing to completely sign off if needed.
Too add more complexity my mom had to move states in November for a job and they still weren’t filed. In January they finally got back to us and said it has been taking some time because of the complexity of her case since she has many income streams (adjunct professor at multiple schools doing 1 or 2 classes each, so she isn’t making much money just a lot of different incomes).
Heres the kicker, they redemanded her income stubs because its been so long and well her income has not changed much at all yet once they got back they said her new payment will need to be 1700 a month for 5 years or 102,000$ total repayment because she is over median (reminder her income hasn’t really changed much). She is totally freaking out. She hasn’t paid any debt in like 7 months. Been pushed around by these paralegals and being told she needs to pay back more then her original debt by a lot more.
What should we do. I dont have another few thousand dollars to waste getting new people to do her case. We also dont have a lot of time to fart around. She has no property and only 1 old car. She has lived with friends, my sister, and now renting a cheap place. She is depressed and thinks there is no hope left, and when this was suppose to be her hope to get out of debt, it has been swindled in front of her.
