Looking to file chapter 7 or chapter 13 by myself. what if I don’t qualify??
Background info….
HELOC 257,000 on home valued at 400,000
Credit cards approximately 60,000
Gambling issues but have made great gains in getting it under control. (Please be kind here, I am totally aware of what this has caused)
Debt attorney debt program paying 1250 on credit cards debt
HELOC 2400
Income social security disability 3000/2400!after taxes
Disability retirement 4600/4200 after taxes.
Husband has put a retainer on a divorce attorney and has instructed her to work up an agreement for me to sign 🙄 I have not seen this yet. He wants to sell the house. I do not want this even though life is misery.
He does not want to file BK. I now have given my debt attorney all the info necessary to complete the means test (his income too because it’s household) and we have an appointment to discuss on March 31. I need to do something as after paying the loan and all other things there isn’t anything left. Husband’s money is husband’s money. All the debt is mine including the HELOC. not all debt on that is gambling but some is. So, after giving all info to the attorney’s assistant there is about 2200 left. This would be “his” money.
I have used Cash App, Venmo, and other cards/accounts of this variety as debit at the casino. No cash advances on these. Should I wait a couple months so that the bank statements/apps don’t look so bad??
The questions:
Ch7 or ch13
I want to keep my home.
I want to pay the HELOC as he isn’t responsible and isn’t his…
If disposable is too high, , if I buy a car to absorb some of the disposable income this would help and I need a new. I’ll figure it out)
Has anyone went through bankruptcy and divorce at the same time? I’m going to have to give bank statements, win/loss, etc and gambling transactions are on all. Yes I am aware how bad it is/was. How will this affect my ability to file? Better to wait a mint or two?
Omg, so sorry this was long and I hope you all that are reading are able to process as my eyes are starting to close. All opinions are welcome, please and thank you. .
