hello, I am getting sued for an unpaid target card. I have no personal income, I am married and he works, 80k is what he grossed this past year in Indiana, 2 kids we claim but they are not his, I already know they will use his income in my filing. I own nothing anymore , no home, living in an extra family house for now, no car and I no longer work due to brain tumor. I want to file bankruptcy but am wanting to wait til after my surgery this spring to have them cover it in because its a brain surgery and gonna cost a lot! My question is, if they make a judgment against me for the 2200 dollars in court, can I still file bankruptcy on that? I know I can if I am getting sued but after I have been sued and there is a judgment can I file against it?
edit: I have 40k in debt but more coming with my surety hence the question if I can’t wait even after the judgment.
Extra question: can I go to jail for not paying since I have no income coming in if I wait. just wondering, Will talk to a lawyer later but can’t afford it right now. Thanks
