I am filing solo, my wife isn’t filing with me. I met with an attorney back on June 2nd, not the head attorney of the firm I hired but an associate. He ran the numbers of her income and mine and we talked, he took down my expenses, and he decided I did not qualify for a 7 and said we were going to do a 13. I didn’t have my most recent paystubs or hers, so he told me to send them in. We scheduled the signing the petition for today. I came to terms that I would have a 13, began bracing for the monthly payments, etc
Today I go in, and I meet with the head attorney of this firm. He sits down with me (first time he’d met me in person), goes over my numbers. He decides to do the means test again, but this time unlike the other guy, he has me call my wife even though she isn’t filing with me and gets the minimum payments of her bills. Come to find out her two consolidation loans she did had big enough minimum payments that when he included those and my cat’s prescriptions and their prescription foods, it changed the means test immensely to where he said he had a 65-70% confidence that he could get me a chapter 7! I was in shock, I’d totally written off the possibility of a completely clean slate. Signed the petition, and now we are off to the races. Fingers crossed.
