Hi there! I just wanted to provide relief for anyone who is nervous about their meeting. I have complied a list of questions that were asked since the same questions were asked multiple times before they got to me. I filed Chapter 7 in North Carolina. Edit: if you are filing joint, they will ask husband and wife same question .. ANSWER YES OR NO. KEEP IT SIMPLE. the more you talk…the more they ask.
Personal Information
- Raise your right hand..blah blah blah.. State your full name and the last four digits of your Social Security Number.
- Are you representing yourself?
Petition Review
- Have you reviewed your petition?
- Is it true and accurate?
- Do you wish to make any changes to the paperwork?
- Do you have any questions or concerns/ did you understand it?
- Are there any changes that need to be made on your record?
Address and Residency
- Has your mailing address changed, or have you moved since filing?
Assets and Claims
- Will ask about vehicle value and how it was determined if you are planning on keeping or surrendering it..
- Will ask about your business and assets related to it (equipment value, inventory value)
- Will inquire about any open claims that may result in you receiving a large sum of money (e.g., workers’ compensation, court cases)
- Will ask about large withdrawals of money and what you did with the money, and if you still have the money now…(for me, I made a 401k withdrawal to pay up my rent when I got laid off so that was pretty much the end of questioning when I told them that)
Previous Bankruptcy and Financial Status
- Have you filed for bankruptcy before?
- Are you expecting an inheritance?
- Do you own any real estate?
- Do you owe child support or alimony to a third party?
- Why did you file for bankruptcy? (they did not ask me this, but asked a few others this)
Documentation
- Did you have a chance to review your paperwork?
- They will ask about any missing paperwork or filing fees.
- Note: The case may continue if you still owe money.
Additional Questions
- Bankruptcy administrator may ask if children live with you full-time and confirm Household size
- Note: They did not ask me this even though I do have a child, but someone stated they were a single dad of 3 but his paperwork listed just 1 child so it was a discrepancy.
- They will address if you don’t pass the means test or if there are any discrepancies in your paperwork.
- Note: Basically, make sure everything is correct and truthful on your paperwork
- IF ANYTHING HAS CHANGED IN YOUR FINANCIAL SITUATION NOTIFY YOUR ATTORNEY IMMEDIATELY AS AN AMENDMENT WILL NEED TO BE DONE BEFORE COURT.IF IT IS DISCLOSED AT COURT BUT THE FORMS ARE NOT UPDATED TO REFLECT CHANGE, THEY WILL PUSH COURT DATE OUT FOR ANOTHER MONTH OR MORE.
I myself hired an attorney for a grand total of $1,998 and I just want to be say I noticed a pattern at court today. The only people that were having issues with incorrect paperwork/discrepancies were people that were representing themselves. Get a lawyer lol. Good luck to all!!
