Yesterday, in the mail I received a bill from a debt collector that bought the debt from the original creditor. It was in February of this year when I got the loan. I used the loan just to get by.
By the way, I had my 341 meeting earlier today in the morning. It went smoothly and no issues.
I filed Chapter 7 bankruptcy last month.
I spoke to a man from the debt collector company. Told me they are willing to settle for 50% or 60% off the total balance. I owe $1,584.13.
With a smile on my face, I told them I filed Chapter 7 last month. He saw the case number and everything else on his end. I told him I do not understand why this debt is not part of my Chapter 7 bankruptcy? What makes this debt magically not part of my debts that I gave my bankruptcy attorney to?
Funny part: he told me I still need to make a payment regardless of my Chapter 7 bankruptcy. He said “because you applied for and got the loan in February of this year months before you filed for Chapter 7 bankruptcy. It’s a separate claim”. LMAO!
I included this debt and sent all the required information to my bankruptcy attorney a few months before I filed.
Just had to share this information. He still told me I still need to make a payment and still told me the settlement amounts. He also told me “we are not required to speak to your attorney”. LMAO
