I was hesitant to write anything since I was convinced my student loan payment would reappear eventually but since it has been 8 months since my discharge, I want to share that my 70k consolidated private student loan was discharged off my SOFI account during bankruptcy. I wasn’t expecting it at all but sharing for others.
For more context- I had refinanced and consolidated a few student loans and had been paying them through SOFI for about 6 years consistently before filing. I had about 7 years left on my repayment plan and my lawyer said she would try to put it through but student loans weren’t discharged in chapter 7 so I fully expected to keep paying them. However SOFI never started up the repayment and about 2 months after my 341 hearing, it completely disappeared from my account. A month after that (around when I was discharged), it disappeared from my credit report. I really don’t know how I got so lucky but sharing in case others want to push their lawyers to try to include private student loans on your filing. I filed in CA.
8 months later, despite being a stressful process, it was the best decision I could have made. Debt free, student loan free, 700 credit score and my AMEX stayed active throughout with a 2500 limit. Now I keep my expenses really low/live below my means and am so appreciative of the new found freedom I have been given!
