Looking for advice on dismissing a chapter 13. I think our lawyer just is not the best and did not really help us at all. Our income is around $190k and about $149,000 of unsecured debt and ~$35k federal student loans. Anyways, they have us paying $7000/month ($2800 mortgage, $1300 cars, and $2700 is the debt repayment). And we are paying 8.75% interest to our unsecured creditors.
Expenses:
-Childcare $1100
-Food (family of 5) – $1400 and that’s pushing it now
-Car Insurance – $245
– Health insurance $275
– Gas $400
– Cell phone $180
– Electric $350
– Internet $60
Doesn’t include we now have to front my husbands traveling expenses for work because there is no company card and he lost his CC he was using (he gets reimbursed) but hotels, rental cars, etc add up. There’s no room for any of this. And if he doesn’t travel, then he will lose his job,
And then well we won’t be paying anything.
Anyways, this leaves us no room for clothing for 3 growing kids, can’t pay our trash service anymore. There’s several other things we can no longer pay. We are negative each month. We had to fix our AC to the tune of $3000 last month. How we came up with that, I have no idea.
But here’s the thing with our lawyer. Our case is just days old confirmed. May 18th it was confirmed. Our attorney is telling us we don’t need to report bonuses or submit tax returns anymore. Basically they said if the trustee doesn’t know then they can’t say anything about them. And that our file gets tucked away and not looked at unless something like nonpayment pops up. This doesn’t sound right to me. We are thinking of dismissing and maybe refilling with a different attorney. We feel very led astray and like we were set up for failure. Thoughts?!
