I’m not sure what route to take about getting the vehicle title. My wife and I went through a bankruptcy 2 years ago for medical debt. We decided to give back one of our vehicles and keep the other. The car in question was from Carmax and they know about the bankruptcy and have all the paperwork because the case is over and discharged 2 years ago. I made several phone calls to them about where it is and that they need to come pick it up. They have had our address before the bankruptcy happened. Under guidance from our lawyer, we sent them a letter stating that the paperwork has been discharged and that they have a certain time to pick it up from us and then we will charge a storage fee going forward. The tags and plates expired on the vehicle and we are not paying to renew them, obviously because we don’t have any rights to this vehicle. I got a parking ticket for it because of the expired tags and had to move it from the public street into our alley and is now taking up our actual parking spots.
Because of the plates, the county says I’m responsible and I had to pay the fine. It has been 2 years from discharge and CarMax has not responded beyond the initial claim that we owed them for the car loan.
What can we do to get the title and sell it ourselves? Is there an abandoned title or some way to claim ownership because it is on our property and they never responded?
