My wife and I were attempting to file for Chapter 7 bankruptcy together in California. They informed us that we had made too much money. However, I was able to file for bankruptcy without my wife. Three months later, my discharge date was August 17. My wife reached out to the same law firm to inquire if she could file now that my case had been discharged. They assured her that she could file without any issues. They also asked why we hadn’t filed for bankruptcy together. We were told that the median income for a family of three in California is around $113,000. I make approximately $37,000, and my wife makes $72,000, which totals $109,000. However, if the lookback period is 6 months, my question is why the lawyer would refuse to allow both of us to file for bankruptcy?
