Im seriously overwhelmed with my finances and could use some advice from people who’ve been through bankruptcy or a debt management plan.

I currently have a little over $50k in debt. I’ve paid over $30k toward credit cards this year alone, despite taking home only around $40k YTD. I’ve averaged roughly $4k a month in payments, yet I feel like I’ve barely made any progress.

I was also unemployed for several weeks before recently starting a new job paying around $70kish, which is actually a pay cut. Unfortunately, my new commute is over 100 miles round trip every workday.

My car is leased, and I’ll likely exceed my mileage allowance months before the lease ends, creating another financial problem.

Chapter 7 vs. Chapter 13

I recently consulted bankruptcy attorneys who weren’t optimistic about my qualifying for Chapter 7 because of my new salary. But I’ve only just started this job, and my income over the previous several months was significantly lower due to unemployment.

Since those consultations, I’ve been seriously considering Chapter 13, but honestly, it terrifies me.

The thought of having my finances scrutinized for 3–5 years, potentially having little flexibility, and worrying about unexpected expenses or job changes makes me extremely anxious. I’ve read stories about people struggling with or failing their repayment plans.

My biggest concern right now is what to do before filing.

I’m current on almost all my credit cards, except one that recently fell behind. I’ve been trying so hard to keep paying everything, but I only have a few thousand dollars left in the bank.

I’m questioning whether it makes sense to continue sending most of my income to creditors if I’m likely to file bankruptcy anyway.

I’ve also considered a legitimate nonprofit debt management plan (DMP), but I’m nervous about the horror stories I’ve heard about debt relief programs. I understand DMPs and debt settlement aren’t the same thing.

These are my main questions:

  1. Chapter 7: Has anyone qualified after a period of unemployment followed by starting a new job? How much did your new salary affect the means test?

  2. Stopping payments: If you’re preparing for bankruptcy, does it make sense to stop paying unsecured credit cards and preserve money for living expenses and attorney fees? How did you handle this?

  3. When to file: Would waiting a couple of months before filing Chapter 13 make sense, or could delaying create more problems?

  4. Living under Chapter 13: How restrictive is it really? Can you save money, handle emergencies, or make ordinary financial decisions without constantly worrying about the trustee?

  5. Car lease: Should I start saving for the inevitable excess mileage charges, consider buying out the lease, or address the transportation issue before filing? How would this affect a Chapter 13 plan?

  6. DMP vs. bankruptcy: Has anyone successfully handled this level of debt through a nonprofit DMP, or do you wish you’d filed bankruptcy sooner?

I’m not planning to stop payments or make major financial decisions without speaking to an attorney again. I’m mainly trying to understand what others experienced.

What’s especially frustrating is knowing how much I’ve already paid this year while still having so much debt. Part of me wishes I’d explored bankruptcy sooner instead of exhausting so much of my income trying to stay current.

I’m scared of Chapter 13, but I’m also scared of continuing like this for years.

I’d really appreciate hearing from anyone who has been in a similar situation, especially those who were current on their cards before filing or were initially terrified of Chapter 13.

Did filing actually give you the financial breathing room you were hoping for?
