It’s been 11 days since my 341 meeting. During a meeting with my bankruptcy attorney, we discussed my desire to reaffirm my auto loan. I decided to pursue this option because my vehicle has approximately $6,000 to $8,000 in equity.
Since my 341 meeting, no reaffirmation agreement has been sent to my attorney. I followed up with him by email, and he told me that Chase has not sent him the agreement. He also said he would not personally contact Chase to request it.
According to my attorney, if Chase doesn’t send the reaffirmation agreement before my debts are discharged, the auto loan will be discharged as well. However, he said I could continue making payments until the loan is paid off, at which point I would have the lien released.
Is it normal for a bankruptcy attorney to refuse to follow up with a lender about a reaffirmation agreement?
Given that my vehicle has about $6,000 to $8,000 in equity, would reaffirming the loan be in my best interest?
If my attorney refuses to follow up with Chase, can I contact the lender myself to request the reaffirmation agreement?
I’d appreciate hearing from anyone who has dealt with a similar situation or has experience with bankruptcy and auto loan reaffirmation. Thanks!
