I’m really worried my chapter 7 is not going to be discharged. My husband’s income increased due to overtime (3 people at his job quit so they were understaffed) for 2 months. He went from making $900/wk to $1400-1600/wk. His income has went down now and ranges from $1000-$1300/wk, but it has not returned to the levels reflected in my budget. He has been at this job for 10 years and it always fluctuates like this. It’s impossible to predict exactly when it will go down, but it always does.
I’m worried the trustee will see this and push us into a 13. I’m already not taking one of the medications I need due to not being able to afford it, so there’s 0 chance we can do a chapter 13. We’re under median for a family of 4 either way, but our rent is relatively low and we drive paid off cars. Filing bankruptcy is entirely due to my medical expenses.
I’ve had a lot of issues with the law firm I chose, so even though my lawyer said everything is fine I still have doubts. I’ve had 4 different case managers since June. I paid in full and sent all docs in early July and they didn’t file until late September. It seems like no one ever knows what is going on. Sometimes it takes up to a month to get a response back to a single question. I found mistakes with my petition that I would not have known about had I not looked my case up on Pacer. These mistakes were not there at signing, so I’m not sure what happened but that combined with everything else has made me feel uneasy.
I know I’m anxious, but this has been such a long and stressful process.
