Hello, currently in the process of filing ch7 and I’m worried about getting pushed into ch13. I make a little less than 32k a year, my rent+utilities is roughly $900 a month along with other essential spending on things like dental work, contact lenses, food, gas, car maintenance I would say I’m left with roughly $100 or $200 extra on a good month. Some months I’m in the negative.
From what I understand the trustee will use all the information I provide and then they will tell me how much DMI they believe I have, is this true? If so, how much would be too much in this situation to push me into ch13? I absolutely cannot afford the $6500 filing fee for ch13 so I’m very worried about this, thanks in advance.
Edited to add: filing in Illinois if that matters with around $19000 in credit card debt
