I’m feeling a little discouraged. My husband and I met with three different lawyers today, and 2/3 said we don’t qualify for chapter 7 because we will fail the means test. One lawyer (senior paralegal) asked us to send him the last 6 months of our paystubs to run a full means test.
I was really hoping we would both qualify for chapter 7 and file jointly, but I guess our combined income is too high. I make around $3,800 monthly, and he makes $5,100 monthly before taxes. Our monthly expenses is around a combined ~$4,000 for rent, utilities, groceries, gas, insurance etc. We don’t have any car payments, and our rent is only $1,100 total since we live on his mom’s property otherwise we would be homeless.
My question is: is there any opportunity for us to file separately and get approved separately? Should I talk to more lawyers and get more opinions about filing jointly?
Here is a snapshot of our debt:
Mine – ~$101k (unsecured), $6,700 (secured; student loans and IRS)
His – ~$48k (unsecured), $4,300 (secured; IRS)
He also has one lawsuit that has been filed, but not served.
Joint card – ~$24k (unsecured)
