For reference my wife and i are both active duty. if you don’t know we receive BAH, which is untaxable income and roughly $2,800 per month. all of my BAH goes to housing on base, and my wife keeps hers, we have a child as well. so roughly i get about $1,500 per paycheck and we are in california.
i have around $40,000 in credit card debt. i paid my lawyer in full (over 4 months) and he asked for my spouses pay stubs and bank statements and is now saying im over the means tests and i will have to file chapter 13, with a 800-900 payment a month for 5 years.
i do not want to do a chapter 13, i cant afford to pay that. i dont know what to do at this point. i dont understand why my spouses income gets added when i am filing by myself? what am i supposed to do? am i screwed?
