I filed Chapter 7 today. I have an HSA with about $2,000 in it (no contributions in years). My paralegal said I don’t need to list it, but my own research says HSAs are estate property and must be listed.
Questions:
- Is my paralegal wrong? Do I need to list this?
- Can I still amend my schedules since I just filed today?
- Should I contact my attorney directly about this instead of the paralegal?
- Could this omission get my case dismissed, or will the court treat it as an honest mistake given the small balance?
