I filed Chapter 7 today. I have an HSA with about $2,000 in it (no contributions in years). My paralegal said I don’t need to list it, but my own research says HSAs are estate property and must be listed.

Questions:

  1. Is my paralegal wrong? Do I need to list this?
  2. Can I still amend my schedules since I just filed today?
  3. Should I contact my attorney directly about this instead of the paralegal?
  4. Could this omission get my case dismissed, or will the court treat it as an honest mistake given the small balance?
