So I posted a week or so ago about our case being dismissed (chapter 13) at no fault of our own. Fast forward to now I finally had someone from our firm call about it yesterday. They are claiming it was dismissed because the trustee requested our last 2 years tax returns (which we gave the firm months ago) & they’re claiming they weren’t signed but never told us anything until a month ago when the trustee submitted a motion to dismiss the case (which I had to call my firm to let them know we had received these papers in the mail, they never notified us). Well they then requested a signed copy of the returns which I had signed & returned same day, they “supposedly” faxed the signed returns to the trustee that week (end of August) & needless to say the trustee still dismissed the case on 9/17. Well yesterday they are pretty much not taking blame for the dismissal when we did everything on our part like giving them everything they needed document wise on top of making our plan payments on time. They told us we could reinstate the case for $775 (which I think is bs because we didn’t cause this case to be dismissed) or start over new & get re-qualified for a chapter 7 for $500 & then whatever they are going to charge to file. Is this common practice amongst firms because I’m not trying to get out of paying anything I feel like we have to pay, but for them to charge us to re-calculate or reinstate I think is wild since we’re in this current situation because they failed to follow up with the trustee and make sure they had exactly what they needed before we even filed.

We have a consult with another firm in a week I’m trying to get more opinions on what we need to actually do. Has anyone else had a similar situation & changed firms? I’m skeptical filing with them again because of what has already happened.
