I was told my first payment for my CH13 filing is due 30 days after filing. That’s in two days.
I was told by my lawyer that I could break them into bi-monthly payments as I get paid every two weeks.
I went to make my first payment today. My monthly is $3,400. So the bi-weekly would be $1,700. I had it in my head to make that payment.
I signed up for the payment service tonight and signed up for bi-weekly withdrawals from my checking account. I made what I figured was my first bi-monthly payment: $1,700.
But upon reviewing my paperwork, I suspect they are expecting a full $3,400 for my first payment. I don’t have that kind of money in my account. My net pay is only $2,500/mo and I spent all of that except for $1,800 on groceries and some bullshit, figuring as long as I made that first bi-weekly payment, I’d be okay. I have a total of $1,825 in the bank right now, so $125 leftover from the payment I just made.
I’m going to call my lawyer tomorrow. I can make the next payment when I get paid next Friday, two days after my court date.
How much trouble am I in?
Thanks for any insight.
