I am considering filing bankruptcy. I have not had a consultation yet, but I’ve been trying to research as much as possible. After going down a rabbit hole trying to see if my budget would qualify me for a 7 or would 13 be better I hit a snag.

My dad passed away in 2023. The policy he had did not pay off the mortgage so my sister and I split the expense. Initially, she paid it alone, but i now send her $300 a month for the last year and a half. I was including this in the budget. However, I read that since the debt is not legally mine and i don’t live in the home it cannot be considered rent and my sister could be considered an insider and a trustee could potentially claw back the money I have sent her in the past year.

This now adds $300 back into my budget and could potentially put my sister at risk. Does anyone know how this works ? I do plan to seek a consultation soon, but at the moment, any advice is welcome. Thanks
