Hopefully this inspires anyone who may have trouble making a choice on if bankruptcy is right for you.

I was struggling to make ends meet for the past year robbing Peter to pay Paul. Paying over 3k/m on minimum CC bills, auto loans (2) & personal loans. This does not include Rent, food, daycare & basic necessities. Not to mention I have 4 kids… my last straw was getting sued & having a judgement on me. I couldn’t possibly afford that. I was about $120k in debt.

I finally looked in to bankruptcy met with about 4 attorneys. 3/4 told me I would have to do Ch13 & 1/4 told me I could probably qualify for a Ch7. Insurance & daycare helped me w/ the means test since I was over the income limit. We filed 04/17, 341 meeting 05/15, objections to discharge due 07/14 & discharged 07/20. No assets.

Before filing I received my taxes & paid back a family member 2k from when they loaned me money for rent. It was not a thought in my mind at that time that I was going to file bankruptcy. I was super scared that the trustee was going to try to claw back the money from them. But nope I was truthful & that 2k wasn’t worth it to claw back? I guess it depends on the trustee. I thought I was going to get scrutinized forsure but the 341 meeting went smooth.

I’m keeping both vehicles. I did not reaffirm but will continue to make payments.

If you decide to hire an attorney find one who believes that they can help you, not just to make a quick buck.

Glad to put this mess behind me. Off to a fresh start.
