Throwaway. Chapter 13 in Indiana. I filed, my spouse did not. 341 done, next hearing in July.

The house and mortgage are in my spouse’s name. I’m only on the title and we have never missed a payment. Closing was set for last week. My attorney told me the sale would not be affected since I’m not on the mortgage. Then the title company emailed the buyer’s agent saying one of the sellers had recently filed bankruptcy, and now the closing is stuck.

No one told us a motion to sell was even required until the title company raised it. Our realtor didn’t ask if we had filed BK and we didn’t disclose since our BK attorney did not seem concerned. Once it came up, we learned a motion is needed and we have already requested one from our BK attorney. This sale is not optional either, since we are relocating abroad on a fixed timeline and cannot delay it.

I’m turning to this sub because our BK attorney has been essentially non-responsive, and I’m trying to understand what should be happening. Anyone who’s sold property during an active Chapter 13, I’d really appreciate your help. Thanks.
