I began my monthly repayment in May of 2024. I am down to 13 more payments. I have paid every month as planned and went without food, got behind on utilities, really all my expenses due to a change in jobs. I worked 2 jobs to dog myself out of the hole I got myself in – along with my tax refund for the tax year 2024 and 2025. In March of 2026 the trustee requested my tax paperwork for the past 2 years, both show a refund. You guessed it, I have to repay money from my refund, the same money I used to catch up my bills. In addition to that, I wrecked my car, proceeds from that insurance payment went to the trustee. In April of 2026, (last month) my mother passed and left a very small life insurance policy and I am named as the beneficiary. You guess it. Trustee wants every penny not spent on a funeral. So here I am frustrated at myself for withholding too much income for the last two years that I have to pay the trustee almost $5k, the 10k for my car, and now another 10k for a life insurance benefit. I wish I had better knowledge regarding my taxes an I would have been able to have had more to live on during the year versus paying my tax refund into the trustee. My advice is to make sure you’re withholdings are in order. You are allowed to keep child tax credit and earned income if you qualify, anything over, you give away. Regarding my car, I did attempt to get the okay from my trustee to take on new debt but after 6 weeks of no information from my attorney, I had to buy a piece of shit that o ended up having to pay to have fixed multiple times over the last 9 months. I am quickly approaching a 100% repayment plan on a mediocre salary, getting by in party by working every hour of overtime available. If I knew I could keep my house, I would have filed chapter 7 and been done –

The majority of my debt was on medical bills that spiraled into credit cards debt when I was released from my company for exceeding the allowed PTO/sick days

Side note, I have requested to take on more debt for a car, fingers crossed, I can get that clearance from the trustee. Bad part is the small left over amount from the insurance policy would be helpful to pay for sales tax, and a down payment for a new to me car. I’m curious if anyone received a life insurance benefit while in chapter 13, if so, did you disclose it to your attorney?

Cordially yours,

Frustrated and disappointed
