I’m 2 1/2 months from being eligible to file a Chapter 7 but I might get a job offer for $100K salary this Monday, plus a seasonal holiday lighting business that profits about $80K and I’m at a loss as to what to do. Chapter 7 or 13 is inevitable it is just which one based on timing. If I gut it out until filing a 7 in July I might have to take $10K out of 401k to get by. I’ve met with an attorney and she stated if I take the job, or another job I’m interviewing for next week that is $60K salary, that I will be disqualified from chapter 7 and that the trustee will take into my account my Christmas income and new job and force me into a 13. She said my payments on a 13 would be around$2,500 roughly which would be doable if I can land a salaried position with Christmas income but I’m sick to my stomach as to what to do.

I’m not sure if I should turn down the job which could be a good career move for the long term and face my fate with a 13, or turn it down, take a little out of my 401k to survive for a few months to get to a 7 which I could replace back into my 401 after 7 and the try to look for another salaried job after my 341? I’m also curious if info with a 7 If that 3 extra years on a chapter 7 is that bad? Any insight is greatly appreciated.
